Terms of use:

JBJSF.org is owned and operated by Jon Bon Jovi Soul Foundation. The following terms of use (“terms”) govern your use of the site. By using or visiting the site, you expressly agree to be bound by these terms and to follow these terms and all applicable laws and regulations in your use of the site. We reserve the right to change these terms at any time, effective immediately upon posting on the site. Please check this page of the site periodically for such changes.

Disclosure of Personal Information:

JBJSF.org is committed to keeping your personal information strictly confidential. Only the organization of the performance for which donations were made will retain your information. When we collect your personal information (i.e. name, address, e-mail, and telephone number) it is in an effort to improve your experience and to notify you about program updates, services and answer inquiries. Beyond the presenting organization for your event it is our policy not to disclose any of your personal information at any time, unless you tell us to do so. We do not sell, trade or rent your personal information to third parties. From time to time, we’ll share aggregated (collective) information about our members as a group, or generate aggregate reports and market research for business partners. These reports will not identify individual members.

Cookies:

Our site uses cookies to personalize and improve your experience. These cookies do not contain any confidential or personal information. They allow us to enhance your experience at JBJSF.org. For example, if you have added products to your shopping cart and suddenly have to log out of our site, you can return later that day and still have those items in your shopping cart.

Security:

We use industry-standard methods to protect your information from unauthorized access. Among other techniques, we store such information on a computer behind our “firewall” in a secure location, and we restrict the number of employees internally who can access such data. Any data stored is kept in a secure off-site location and stored in a password-protected server. Please be aware, of course, that there is no such thing as perfect security – on or off the Internet. Although we choose our business partners carefully, we can make no representations concerning privacy and security on those sites.

Your password is your key to your account when shopping on the store. You should never share it with anyone and we request that you change it periodically and often. Prohibited Activities:

Commercial Use:

You agree not to use the Site for any commercial purpose, such as conducting sales of tickets, merchandise or services of any kind. Without limiting the foregoing, you may not resell or link to other sites for the purpose of selling tickets of any kind.

Proprietary Rights This Site is owned and operated by Jon Bon Jovi Soul Foundation. The contents of this Site are protected by United States copyright and trademark law, international conventions and other applicable laws. All materials contained in the Site are the copyrighted property of Jon Bon Jovi Soul Foundation or its subsidiaries or affiliated companies and/or third-party licensors (unless in the public domain). All trademarks, service marks, and trade names are proprietary to Jon Bon Jovi Soul Foundation or its affiliates and/or third-party licensors. Unless expressly authorized by us, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works from materials or content available on the Site. Notwithstanding the above, you may use the content and materials on the Site in the course of your normal, personal, non-commercial use of the Site.

Intellectual Property Rights Policy:

We respect the intellectual property rights of others, and we ask our users to do the same. Without limiting any of its other rights and remedies under the Terms of Use, our policy is to terminate access to the Site by repeat infringers of copyright. We reserve the right at any time to suspend, modify or discontinue, temporarily or permanently, any portion of the Site with or without prior notice. You will not be entitled to a refund during service outages that are caused by our maintenance on the servers or the technology that underlies Site. You agree that we will not be liable to you or to any third party for any suspension, modification or discontinuance.

You agree to indemnify and hold harmless Jon Bon Jovi Soul Foundation and the associated management as well as their subsidiaries, affiliates, owners, associates, licensees, licensors, officers, agents and other partners and employees (the “Indemnified Parties”) from any claim, demand, action, damage, loss, cost or expense, including without limitation, reasonable attorneys’ fees, incurred in connection with any suit or proceeding brought against any of the Indemnified Parties arising out of your use of the Site or alleging facts or circumstances that could constitute a breach of any provision of these Terms by you. If you are obligated to indemnify any of the Indemnified Parties, such party will have the right, in its sole and exclusive discretion, to control any action or proceeding and determine whether they wish to settle it, and if so, on what terms.

Exclusion of Damages:

Force Majeure:

We will not be liable to you or any third party for failure or delay in performing our obligations hereunder if such failure or delay is due to circumstances beyond our reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, computer viruses, terrorism, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of the Site.

Arbitration:

You agree that any dispute arising out of or relating to these Terms or your use of the Site will be submitted exclusively to confidential binding arbitration in Austin, TX. Arbitration under these Terms will be conducted under the prevailing rules of the American Arbitration Association. The arbitrator’s award will be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms will be joined to an arbitration involving any other party subject to these Terms, whether through class arbitration proceedings or otherwise. Notwithstanding the foregoing, to the extent you have in any manner violated or threatened to violate the intellectual property rights of the Jon Bon Jovi Soul Foundation or management, these persons or entities may seek injunctive or other appropriate relief in any state or federal court in the state of Texas, and you consent to exclusive jurisdiction and venue in such courts.

Miscellaneous:

The Site is based in and operated from the United States of America. Information which you send to us by email or which we gather from you when you visit our website is held and processed in the United States of America. These Terms shall be binding upon and inure to our benefit, and our successors, and assigns. You may not assign these Terms without our prior written consent. These Terms contain the entire understanding of the parties regarding their subject matter, and supersede all prior and contemporaneous agreements and understandings between the parties regarding their subject matter. The Terms and the relationship between you and us shall be governed by the laws of the State of Texas and the United States of America without regard to any conflict of law provisions. No failure or delay by a party in exercising any right, power or privilege under these Terms shall operate as a waiver thereof. The invalidity or unenforceability of any of these Terms shall not affect the validity or enforceability of any other of these Terms, all of which shall remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or the Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms are for convenience only and have no legal or contractual effect.
